Tips for å unngå inkasso
Har du tatt opp mer lån enn du klarer å betale? Sliter du med å betale regningene dine? Har du mottatt inkassokrav? Her har jeg samlet noen tips som kan være greie å ha dersom du er litt ute og sykle med din personlige økonomi.
1. Feil ved regningen?
Skriv brev eller e-post til fordringshaveren om at du er uenig i kravet. Du må ha en saklig grunn. Returnér eventuelle mottatte varer. Meld fra til inkassobyrået. Hvis inkassobyrået tror på deg, slipper du å få flere krav.
2. Har barna fått inkassovarsel?
Barn under 18 år er umyndige og kan ikke bestille varer hvis du ikke har underskrevet bestillingen. Hverken bedriften eller inkassobyrået har rett til å inndrive slike krav. Klag og send varer i retur.
3. Har du ikke fått inkassovarsel?
Du har krav på et inkassovarsel før et krav sendes til inkasso. Kontakt inkassobyrået hvis du mener å ikke ha mottatt inkassovarsel.
4. Er gebyrene for høye?
Sjekk om inkassobyrået har beregnet riktige renter, salærer og gebyrer. Du har ikke plikt til å betale mer enn inkassobyrået maksimalt har rett til å kreve (se mer på inkasso.no).
5. Ikke slutt å åpne brev!
Regningen forsvinner ikke selv om du fortrenger den. Den kommer bare til å vokse.
6. Mangler du penger?
Lån av foreldre, slekt eller venner. Du kan også be om et kortsiktig lån i banken. Dette er bedre enn alternativet som er inkasso.
7. Dialog lønner seg!
Ring inkassobyrået og be om at kravet deles opp i flere månedlige rater. I noen tilfeller kan du redusere rentene eller hovedkravet, avhengig av avtalen mellom inkassobyrået og fordringshaveren.
8. Dårlig behandlet?
Har du problemer med et inkassobyrå som ikke følger spillereglene? Hos inkassoklagenemnda kan du få hjelp.
9. Saken til Forliksrådet?
Når du får brev om tilsvar, så skriv at du er uenig i kravet. Møt opp! Si din versjon og prøv å få til et forlik. Det er like bindende for fordringshaver som hvis du blir dømt. Sikrede krav (for eksempel boliglån) går rett til Namsmannen.
10. Får du dom mot deg?
Hvis du ikke møter opp i Forliksrådet, får du en uteblivelsesdom. Du må betale rubbel og bit, inkludert rettsgebyrer. Betaler du nå, forsvinner betalingsanmerkningen.
Betaler du ikke, foretar Namsmannen rettslig inkasso. Dette betyr trekk i lønnen hos din arbeidsgiver, eller beslag i luksusting.
